You agree to be bound by these Terms of Use each time you use or access TaleBait.com. These terms may be amended from time to time with or without notice to you. Additionally, if you use services on this site or accessed via this site, you will be subject to any rules or guidelines applicable to those services, and they will be incorporated by reference within these Terms of Use. Also read our Privacy Policy which is incorporated into these Terms of Use by reference.

Guests may enjoy many features on the site, such as reading TaleBait storylines and Open Water postings that members make public. Guests may also Weigh In (vote) on selected submissions and rate Live Bait entries by using icons provided. Membership is required to submit entries to TaleBait storylines, create profiles, and post entries on Open Water.

Registration for an account on TaleBait.com requires a valid e-mail address, a user name, and a password (required for user authentication). We ask for demographic information like zip code or country and whether you are at least 18 years old. You must be 18 years or older to submit entries to this site. We do not disclose your personally identifiable member information or usage to third parties. However, any information you voluntarily upload or post to the site, such as but not limited to stories, critiques or personal profile information, becomes publicly available to other users of the site. By registering for a user account, you explicitly agree to this site's Terms of Use, including any amendments made by TaleBait.com.

Email Policy

Registered members may receive occasional emails from TaleBait.com regarding site news and updates. Anglers (members) will receive emails when their submission to a TaleBait storyline is selected for Weigh In (voting). We may add additional prompts in the future. Third parties are not permitted to send emails to our member list. Member email addresses are not revealed on the web site.  TaleBait.com prohibits members from engaging in spam email.

Services Provided

Use of TaleBait.com and the related services are provided to you on an "AS IS" basis. You agree that the TaleBait.com owner and staff reserve the right to modify or discontinue the site and its services, and to remove the data you provide, either temporarily or permanently, at any time, without notice and without any liability. TaleBait will not be held responsible or liable for timeliness, removal of information, failure to store information, inaccuracy of information, or improper delivery of information.

Validity of Posts

TaleBait.com staff and owners cannot confirm the validity and suitability of posts. Please remember that we do not actively monitor all posts, especially posts to Open Water, and therefore, are not responsible for that content. We do not warrant the accuracy, completeness, or usefulness of any information presented. The posted submissions express the views and work of the author, and not necessarily the views of TaleBait.com, staff, owners, affiliates, or assigns. You agree that TaleBait.com may expose you to content that may be objectionable or offensive. TaleBait is not responsible to you in any way for content displayed on this site, nor for any error or omissions.

Anyone who feels that posted content is objectionable is encouraged to notify a TaleBait editor immediately. The staff and the owner of this site reserve the right to remove objectionable content, within a reasonable time frame, if they determine that removal is necessary. This is a manual process, however, please realize that they may not be able to remove or edit particular submissions immediately. This policy applies to member profile information as well.

Password

You are responsible for maintaining the confidentiality of your password, and you are responsible for all usage of your user account and/or user name (Angler name), whether authorized or not authorized by you. You agree to immediately  the site administrator of any unauthorized use of your user account, user name or password.

Content and Conduct

You agree that all Content (information or data of any kind, including text, software, code, music or sound, photos or graphics, video or other materials) made available publicly or privately, will be under the sole responsibility of the person providing the said content, or of the person whose user account is accessed.

By using TaleBait.com or any service provided, you explicitly agree that:
1.    you will not provide any content or conduct yourself in any way that may be construed as: unlawful; illegal; threatening; harmful; abusive; harassing; stalking; defamatory; libelous; vulgar; obscene; offensive; objectionable; pornographic; designed to interfere with or disrupt the operation of this site or any service provided; infected with a virus or other destructive or deleterious programming routine; giving rise to civil or criminal liability; or in violation of an applicable local, national or international law;

2.    you will not impersonate or misrepresent your association with any person or entity; you will not forge or otherwise seek to conceal or misrepresent the origin of any content provided by you;
3.    you will not collect or harvest any information about other users;

4.    you will not provide, and you will not use this site to provide, any content or service in any commercial manner, or in any manner that would involve junk mail, spam, chain letters, pyramid schemes, or any other form of unauthorized advertising or commerce; you will not use this web site to promote or operate any service or content without the site editor's prior written consent;
5.    you will not provide any content that may give rise to the site editor being held civilly or criminally liable, or that may be considered a violation of any local, national or international law, including, but not limited to, laws relating to copyrights, trademarks, servicemarks, patents, or trade secrets.

Copyrights of Content

1.    Users (Anglers) own the copyright in their original content that they post to the Open Water section of the site.
2.    CONTENT THAT BECOMES PART OF A TALEBAIT HOOKS & STORYLINES THREAD IS THE COPYRIGHT SOLELY OF TALEBAIT.COM AND ITS OWNER, CHAMELEON MARKETING CONCEPTS LLC.  Submissions of content to a Hooks & Storylines thread that is NOT accepted into the permanent thread will remain the copyright of the user/Angler. However, when a submission is accepted into a Hooks & Storylines thread the user/angler who submitted the content assigns ALL past, current, and future rights to TaleBait.com and its owner, Chameleon Marketing Concepts LLC. The Angler’s user name will be displayed with the submission in the Hooks & Storyline thread.

Additionally, TaleBait.com and its owner, Chameleon Marketing Concepts LLC, owns the copyright on all aspects of the site original to it, including but not limited to, selection, coordination, arrangement and enhancement of the site, as well as in TaleBait’s original content on the site.
3.    Content on the TaleBait.com Blog may be shared under the terms and conditions of the Creative Commons Attribution-Noncommercial-No Derivative Works 3.0 United States License.

By providing any content to TaleBait.com:
1.    you warrant and represent that you have all legal, moral, and other rights that may be necessary to grant the site editor and owners the rights specified above.

2.    you acknowledge and agree that TaleBait will have the right (but not obligation), at their entire discretion, to refuse to publish, or to remove, or to block access to any content you provide, at any time and for any reason, with or without notice.

Infringement

Unauthorized copying or distribution of copyrighted works is an infringement of the copyright holders' rights and will not be tolerated. We respect copyright law and expect our users to do the same.

Applicable Law

You agree that this Agreement shall for all purposes be governed by and construed in accordance with the laws of Texas, and that any action arising out of this Agreement shall be litigated and enforced under the laws of Texas. In addition, you agree to submit to the jurisdiction of the courts of Texas, and that any legal action pursued by you shall be within the exclusive jurisdiction of the courts of Texas.

Acknowledgement

This Agreement represents the entire understanding between you and us regarding your relationship to TaleBait and supersedes any prior statements or representations.
